This Resource Abuse Policy (RAP) applies to you if MagicWorksHost.com, Magicworks IT Solutions Private Limited, Magicworks’s Partners through Magicworks, Magicworks Vendors through Magicworks (hereafter referred to as MagicWorks, we, us or our) is providing Service to you and your account is in good standing. Terms not defined in this RAP have the meaning given to them in your agreement with MagicWorks.
2. Resource Usage
Any website on our shared servers that uses a high amount of server resources (CPU, memory usage, and network resources) will be given an option to pay for a dedicated server. The abuse and misuse of shared system resources is a serious problem. Accounts on a shared server must share resources with other users so we must limit how much of the CPU and memory that can be used by any one account.

3. Average Server Resource Limits
There are special exceptions to these rules to be determined at the time we discover abuse. There are different combinations of usage that can create problems and other special cases. At any given time a server is unstable and an account is found to be the cause, we reserve the right to suspend the account to keep the server online and operating normally. If the usage is an increasing trend, we recommend the user invest in a dedicated server so the website can grow at a normal rate without restriction.
In the event your website has been suspended for resource abuse (abuse that cannot be resolved by removing/changing a script, etc.) and you do not wish to upgrade to a dedicated server to accommodate your site needs, we will only release the suspension within 24-48 hours. This is to ensure the CPU intensive site slows down in traffic to avoid further damage and problems. A backup will then be provided of your files or you will be allowed FTP/cPanel access for a certain time period. Accounts on any shared hosting account may not have an excessive number of inodes. Any account found to have over 100,000 inodes may be removed from our backup system to prevent overload. Any account seen to be exceeding 250,000 inodes is at risk for suspension. A warning will be sent and if no action is taken to resolve the issue, the account may be suspended. Every file on the account is counted as 1 inode. This includes mail as well as webpage content.
We allow customers to set up cron jobs to perform routine functions automatically. Any client who schedules cron jobs in such a manner that jobs take more then half the time to complete before the next scheduled iteration, and more frequently then 10 minutes is abusing the cron system. Any automated processes that excessively consume resources and impact server stability may be disabled at our discretion by our technicians.
7. Semi-Dedicated and VPS Services
In order to control the VPS hardware node and to ensure that no single VPS account monopolizes the shared hardware resources of the VPS node (CPU/RAM) we use virtual limits to implement certain controls. The limits, or barriers if you will, which are most strictly enforced are the process limits (numproc), the RAM limits, and CPU usage limits. The ‘numproc’ limit which does not actually correlate directly with the number of processes you spawn, rather the number of kernel level threads any VPS account spawns is how the limit of kernel level processes are controlled. Please see below for the specified limits.
VPS1 – 180:180

We strictly limit the amount of RAM that each account is given. With any account, your account may only use the amount of RAM which is guaranteed to your VPS.

VPS CPU Limits
Our VPS offer an equal share of CPU to all accounts sharing the hardware node. With this given, the CPU limits are as follow:
VPS1/2/3/4 – 700MHz Guaranteed, burstable to 850MHz
Any single VPS account which is surpassing the above limitations is considered “Abusive”. Should your VPS be abusive for more than 12 hours you will be at risk of suspension. MagicWorks, reserves the right to suspend, without prior notice, any VPS account which is causing the main hardware node to crash. MagicWorks will, in this case, send an abuse notice once the offending VPS account has been suspended.
8. “Unlimited” Usage Policy:
MagicWorksHost.Com offers some of it’s hosting packages with “Unlimited” amount of resources for specific options (disk drive space, bandwidth, domains per account, and others listed in the features page). This means that MagicWorksHost.Com will not set a specific cap for these resources and client will be able to use these resources as needed, however MagicWorksHost.Com does use a fair usage policy which applies to all accounts. MagicWorksHost.Com Fair Usage Policy implies that if the client uses the resources of the shared server to the extent where he is negatively affecting other users hosted on the same server, the resources may be capped or in some cases, but not necessarily, respectable account may be disabled before client upgrades his account to a package more suitable for his needs or fixes the issues so the resource usage on his account stops to negatively affect other users on the same shared server.
By the term “Unlimited Space” MagicWorksHost.Com means that it will not set a cap on the amount of files the user may host on his account, however the space on the hosting account cannot be used for: Backup storage, Online storage, File sharing services, Movie storage, Photo storage, Software storage, Copyrighted content storage, Illegal, Abusive or Offending file storage, Document Archives or any other type of Archive, File Backups (with the exception of a single cPanel backup generated from your cPanel), log files, etc. MagicWorksHost.Com reserves the right to remove such files from the user account with or without notice to the client. MagicWorksHost.Com also reserves the right to remove any single files larger than 1GB from the user account regardless of the content of the file with or without notice to the client. MagicWorksHost.Com also reserves the right the clean up a user account by removing files which fall under the criteria of files that may not be hosted on MagicWorksHost.Com accounts, if there are more than 250,000 files on a single account, with or without notice to the client. MagicWorksHost.Com also reserves the right to disable the account which holds more than 250,000 files until the relevant shared hosting account is upgraded by the client to a vps service where such limitation is not applied.
Banned Scripts or website types:
The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc. Hosting any type of these sites will result in instant account suspension until the content is removed. On the case that the content was uploaded willingly by the client, MagicWorksHost.Com reserves the right to terminate the account without the possibility of a refund. If the content was uploaded by a 3rd party (hackers, abusers which intend to take the client site down), then MagicWorksHost.Com will inform the client about the abusive content. MagicWorksHost.Com also reserves the right to remove such content from user account without prior notification.
Banned scripts and website types listed below:
Any kind of abusive content found on our servers should be reported to firstname.lastname@example.org. MagicWorksHost.Com will handle any abuse report with the highest priority and interest. MagicWorksHost.Com will not be held liable for any damage or loss that may have arisen from content uploaded to client accounts or actions performed by scripts on such accounts on our shared or vps servers. Client who is the account owner takes full responsibility of the whole account content and all actions that are performed on the respectable account, also takes full responsibility for any and all of damages or losses that may arise from his account content or actions performed by scripts on his account.
Unlimited Hosting Explained
Unlimited disk space? How is that possible?
A logical question you might ask, where do you get your unlimited hard drives from? The answer is – we don’t. We use 3TB (3000GB) hard drives in RAID arrays, and this is a massive amount of space for web hosting users.
We are able to provide unlimited space as not all clients require huge amounts of space on the server. For example, there might be 10 clients who need 1GB of space and then 1 client who needs 200GB. That’s no problem for us.
Can I store anything I want on the account?
This might be one of the important things to be noted, that while we do not limit the space your account takes up on our server, we still require that the uploaded contents comply with our TOS.
Of course, you should never host Copyrighted content like movies or music. Same applies to abusive or illegal content (like child pornography) on our servers. Any of such content found on the account is removed, account may be disabled and we may even take legal actions and report to legal instances on rare cases of extreme abuse.
Unlimited hosting services Backups
We do not take backups of Unlimited Hosting accounts.
This Policy shall be governed by and construed in accordance with the laws within Pune, Maharashtra (INDIA), without regard to choice of law provisions that would cause the application of the law of another jurisdiction.
